A surge in auto glass claims filed against insurers isn�t going away � it�s getting worse. In 2017, there was a 22 percent increase in such lawsuits against insurance providers, according to the Florida Justice Reform Institute. That�s a jump from 19,558 in 2016 to 23,949 in 2017.

The so-called assignment of benefits lawsuits happen following repairs to a driver�s windshield. An auto glass company offers to deal with the driver�s insurance company for them for the cost of the repair, and the driver signs over their insurance rights. If the insurance company refuses to pay the requested repair amount, the auto glass company will sue them.

Often unbeknownst to the driver, the driver�s name is on the lawsuit against the insurance provider because the auto glass company is acting on their behalf. This can cause their premium to increase � along with premiums for other drivers because insurers have higher costs.

Tampa Bay is ground zero for these kind of assignment of benefits issues, accounting for the bulk of the lawsuits.
